Oppositions, Third-party notices and Nullity actions

If you wish to have a competitor's patent declared invalid, you have the choice of an Opposition, a Third Party Notice, or an Invalidity Action.

Before a patent is granted, a Third Party Notice may be filed with the national or European Patent Office.

Opposition to patent

When a patent has already been granted, an opposition to the patent may be filed with the national or European Patent Office for a limited period from the date of grant.

After the patent has been granted and the period for filing opposition has expired, the possibility remains to initiate an action for invalidity. This action is brought before the Court.

Highly specialized work

Since the work involved in oppositions is highly specialized and every case has its own specific characteristics, it will always be necessary to discuss this in detail in person.
